Scope
These Terms apply to:
- Website use: all pages, content, and media on
naileditdevelopments.ca
and subdomains. - Services: consultations, estimates, contracts, renovations (including basement/secondary suites), and related work we provide (service terms will also be set out in your written estimate/contract, which prevails if inconsistent).
Estimates, Contracts, and Changes
- Estimates/quotes are based on information available at the time and are typically valid for the period shown on the estimate (if no period is stated, 30 days). Pricing may change due to market conditions or scope changes.
- A project is authorized when a written contract/estimate is accepted by you (and any required deposit is paid). The contract governs scope, materials, pricing, payment schedule, warranties, and timelines.
- Unforeseen conditions (e.g., structural, electrical, plumbing, hazardous materials, water damage) or design changes may require written change orders that can affect price and schedule.
Client Responsibilities
- Provide safe access to the work area, clear the site of personal items as needed, and ensure utilities (power, water) are available.
- Obtain required consents/approvals (e.g., strata approvals). We can assist with permits where our scope requires them; responsibility will be as set out in your contract.
- Disclose known site conditions that could affect the work.
Scheduling and Delays
We provide estimated schedules. Delivery dates are subject to availability of materials, subcontractors, and permitting. We are not liable for delays caused by events beyond our control (force majeure), including extreme weather, supply chain disruptions, illness, labour disputes, or regulatory delays. If delays occur, we will communicate promptly and work to minimize impacts.
Materials, Standards, and Warranties
- Materials are as specified in your contract or approved selections. Equivalent substitutions may be used if originally specified items are unavailable, with your approval.
- Manufacturer warranties pass through to you. Our workmanship warranty is as stated in your contract/estimate. Misuse, neglect, or third‑party alterations void applicable warranties.
Payments
Payment terms (e.g., deposits, progress draws, due dates, methods) are specified in your estimate/contract or invoice. Late or missed payments may incur interest or administrative fees as permitted by law and as specified in your invoice/contract. We may suspend work for non‑payment after notice.
Site Safety and Cleanliness
We follow applicable safety rules and reasonable housekeeping practices. Renovation areas can be dusty/noisy and temporarily inaccessible. You agree to keep children/pets away from active work areas. Where necessary, we will coordinate containment and cleanup.
Photos, Videos, and Testimonials
With your consent, we may capture before/after media of the work for documentation and portfolio purposes. We avoid showing personal identifiers. You may opt out in writing. Testimonials or reviews you provide may be used in marketing with attribution (name/area) as agreed.
Website Use and Intellectual Property
- Website content (text, images, videos, logos, designs) is owned by or licensed to Nailed It and protected by Canadian and international IP laws. You may view and share links to our content but may not copy, modify, distribute, or use it commercially without permission.
- You must not introduce malicious code, attempt to gain unauthorized access, scrape at scale, or interfere with site operation.
- Third‑party links are provided for convenience; we are not responsible for their content or policies.
No Professional Advice on Website
Website content is for general information only and is not design, engineering, or legal advice. Project decisions should be based on your specific contract and professional guidance as needed.
Limitations of Liability
To the maximum extent permitted by the laws of British Columbia:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to the website or services.
- For website use, our total liability will not exceed $100 CAD.
- For services, our liability is limited as set out in your signed contract/estimate and applicable warranty documents.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for fraud or willful misconduct).
Indemnity
You agree to indemnify and hold harmless Nailed It and its directors, employees, and subcontractors from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or your violation of law.
Governing Law and Disputes
These Terms and any non‑contractual obligations are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. The courts of British Columbia (Kelowna Registry, where applicable) have exclusive jurisdiction for disputes not otherwise subject to an arbitration or dispute‑resolution clause in your service contract.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date. Continued use of the website after changes means you accept the revised Terms.
